By downloading, accessing, or using the Walking Monitor mobile application (the "App"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App. The App is intended for personal, non-commercial use to help you track walking activity and general wellness goals.

You agree to use the App only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the App. You are responsible for maintaining the confidentiality of any account information and for all activity that occurs under your account. We reserve the right to suspend or terminate access to the App at our discretion if these Terms are violated.

We respect your privacy. Walking Monitor collects only the information needed to provide its features, such as step activity, goals you set, and basic device information. Where applicable, health and activity data stays on your device or in your personal account and is not sold to third parties.

We may use aggregated, anonymized data to improve the App. You may request access to, correction of, or deletion of your personal data at any time by contacting us at contact@walkingmonitor.com. By using the App, you consent to the collection and use of information as described in this policy.

We take reasonable technical and organizational measures to protect your information, including encryption in transit where appropriate and limiting access to data on a need-to-know basis. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you connect third-party services such as a music app, those services operate under their own privacy policies, and we encourage you to review them separately.

We retain your information only for as long as it is needed to provide the App's features or as required by law. If you delete your account or request deletion, we will remove your personal data within a reasonable period, except where we are legally required to retain certain records. Depending on where you live, you may have additional rights under laws such as GDPR or CCPA, including the right to access, correct, port, or restrict the processing of your data — all of which you can exercise by contacting us at the email above.

The App and all content within it are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that the information and estimates it provides (including step counts, distance, and calories) are accurate or complete.

Your use of the App is at your own discretion and risk, and you are solely responsible for any decisions or actions taken based on the information it provides.

Walking Monitor relies on your device's sensors and operating system to estimate activity. Factors such as how you carry your phone, device model, sensor calibration, battery-saving settings, and background-app permissions can all affect the accuracy of step counts and related metrics. The figures shown are intended for general motivation and awareness rather than precise measurement.

Any third-party names, apps, or trademarks referenced in the App (for example music services) belong to their respective owners and are mentioned only for compatibility and convenience. Their inclusion does not imply endorsement, sponsorship, or affiliation. We are not responsible for the availability, content, or performance of any third-party service you choose to launch or connect.

Walking Monitor may offer optional in-app purchases or subscriptions. All payments are processed by the Google Play Store under their respective terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, and can be managed or cancelled through your app store account settings.

Refunds are handled according to the policies of the applicable app store. We are unable to process refunds directly for purchases made through these platforms.

Prices for any paid features may vary by region and are shown in your local currency at the point of purchase, inclusive of applicable taxes where required. From time to time we may offer free trials, introductory pricing, or promotional discounts; unless stated otherwise, a paid subscription begins automatically at the standard rate once any free trial period ends, so we recommend reviewing the terms before a trial concludes.

We reserve the right to change the features included in any plan, adjust pricing, or discontinue a subscription offering, with reasonable notice where required by law. If we make a material change to a subscription you are actively paying for, we will aim to notify you in advance so you can decide whether to continue. Cancelling a subscription stops future renewals but does not retroactively refund the current billing period unless the app store's policy provides otherwise.

All content, trademarks, logos, designs, and software associated with Walking Monitor are owned by or licensed to us and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the App without our prior written permission.

The Walking Monitor name, logo, and visual design are our trademarks and may not be used in connection with any product or service without our prior written consent, or in any manner that is likely to cause confusion or that disparages or discredits us. All rights not expressly granted to you are reserved.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use. If you submit feedback, suggestions, or ideas about the App, you agree that we may use them freely, without obligation or compensation, to improve our products and services.

To the fullest extent permitted by law, Walking Monitor and its creators, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages, or any loss of data, profits, or health outcomes arising from your use of, or inability to use, the App. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

Because Walking Monitor is a general wellness tool and not a medical device, we are not responsible for any health decisions you make based on the information it displays. You acknowledge that physical activity carries inherent risks and that you assume full responsibility for exercising safely and within your own limits, as described in the Medical Disclaimer above.

To the maximum extent permitted by applicable law, our total aggregate liability for any claims arising out of or relating to the App or these Terms will not exceed the greater of the amount you paid us for the App in the twelve months preceding the claim, or ten U.S. dollars (USD $10). You agree to indemnify and hold harmless Walking Monitor and its creators from any claims, damages, or expenses arising from your misuse of the App or your violation of these Terms.

We may update these terms, policies, and disclaimers from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised terms.

When we make significant changes, we will update the effective context within the App or on this page, and where appropriate we may provide additional notice. We encourage you to review this page periodically so you stay informed about how we protect you and what is expected when using Walking Monitor.

These Terms are governed by the laws of the jurisdiction in which Walking Monitor operates, without regard to conflict-of-law principles. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision will not be considered a waiver of that right.
